The Most Ethical Surrogacy Reform Passes in NY, Finally!

Albany lawmakers pass landmark surrogacy reform, after years of deliberation and negotiations. In a marathon budget session, New York lawmakers passed on April 2, 2020, The Child Parent Security Act (CPSA), the most protective and forward-thinking surrogacy legislation in the country. Only Michigan and Louisiana continue to ban gestational surrogacy for LGBT individuals and couples, Michigan banning gestational surrogacy for all Michiganders. Men Having Babies has advocated for this reform over the years, and MHB staff and members have been extensively active in lobbying for the CPSA. MHB now offers answers to Frequently Asked Questions (FAQs) about the bill, and how it may impact our members' surrogacy journey.

MHB Leads Community Organizations to Present “The Full Case for NY Surrogacy Reform" - See Full Video Coverage

Several leading community organizations joined MHB on November 8, 2019, to present The Full Case for NY Surrogacy Reform. The program offered in-depth look at core ethical and legal issues related to the surrogacy debate in general, and in the context of the proposed "Child Parent Security Act" (CPSA), which would reverse the ban on compensated surrogacy in New York State. The co-sponsors for this event included RESOLVE: The National Infertility Association, Family Equality Council, Equality NY, Stonewall Democrats of NYC, and The Academy of Adoption and Assisted Reproduction Attorneys. The program is part of MHB’s Advocacy and Research Forum series

MHB warns of irresponsible attacks on surrogacy families

As we wrote before, a bill in Albany has the potential to finally make surrogacy legal (only 2 other states still do not allow this…). It is the best legislation we have ever seen, with a “Surrogate Bill of Rights,” measures to make sure women are not exploited, and protections to all involved. However a vocal opposition may prevent it from even getting a vote in the Assembly, vilifying surrogacy as “baby selling”, “child trafficking," etc. Their irresponsible and false attacks may not just lead to a missed opportunity, but also to lasting stigmatization of our families.

MHB calls for legalizing surrogacy in New York State

Men Having Babies is calling for legalizing surrogacy in New York, describing the proposed Child Parent Security Act (CPSA) as "the most comprehensive and thoughtful surrogacy legislation ever drafted." MHB is urging the thousands of NY gay men in its network, current and future fathers, to encourage their legislators to pass the bill, and join us for the June 11th Albany Lobby Day.

On May 29, 2019, MHB's executive director, Ron Poole-Dayan, joined several experts and community leaders to testify in hearings about the CPSA at the NY Senate Judiciary Committee chaired by Senator Brad Hoylman. Poole-Dayan offered the perspective of our board and team, which includes parents, surrogates and allies. He spoke about the need for the CPSA, its alignment with MHB's Framework For Ethical Surrogacy, and our hope the legislature steers clear of amendments that can render the bill not just ineffective but also harmful.
